Tous les pays africains n’exigent pas de leurs ressortissants le port d’une carte d’identité nationale, mais ils sont de plus en plus nombreux à le faire. Les États membres de la CEDEAO se sont engagés à introduire une carte d’identité biométrique de forme commune en 2017. L’introduction de ces nouveaux systèmes est peut-être basée sur des préoccupations en matière de sécurité nationale ou d’amélioration de la prestation des services publics ; mais pour que ces objectifs soient atteints, il faut veiller à ce que des personnes ne soient pas arbitrairement exclues de l’acquisition de ces documents en vertu du droit et des procédures.
Tout citoyen doit avoir droit à un passeport, permettant les déplacements internationaux, et ce document ne devrait pas faire l’objet de retrait, sauf dans le cadre d’une procédure régulière (par exemple, pour une personne accusée d’un crime grave).
Seuls quelques pays africains ont une procédure judiciaire indépendante pour l’obtention d’un «certificat de nationalité » ou d’un document qui constitue une preuve irréfutable qu’une personne a la nationalité du pays.
