{"id":1558,"date":"2016-06-20T12:27:33","date_gmt":"2016-06-20T12:27:33","guid":{"rendered":"http:\/\/test.hennhoneyball.com\/namibia\/"},"modified":"2024-09-26T15:49:10","modified_gmt":"2024-09-26T15:49:10","slug":"namibia","status":"publish","type":"page","link":"https:\/\/citizenshiprightsafrica.org\/en\/southern-africa\/namibia\/","title":{"rendered":"Namibia"},"content":{"rendered":"<p>Nationality in Namibia is governed by the <a href=\"http:\/\/citizenshiprightsafrica.org\/namibia-constitution-1990\/\" target=\"_blank\" rel=\"noopener noreferrer\">1990 Constitution<\/a> and <a href=\"http:\/\/citizenshiprightsafrica.org\/act-to-further-regulate-the-acquisition-or-loss-of-namibian-citizenship-1990\/\" target=\"_blank\" rel=\"noopener noreferrer\">citizenship act<\/a>, as <a href=\"http:\/\/citizenshiprightsafrica.org\/namibian-constitution-second-amendment-act\/\" target=\"_blank\" rel=\"noopener noreferrer\">amended in 2010.<\/a> The law provides for citizenship on the basis of descent, and also for a child born in Namibia to acquire citizenship at birth if the parents are &#8220;ordinarily resident&#8221; in the country. Dual citizenship is permitted for those who have citizenship from birth; the <a href=\"http:\/\/citizenshiprightsafrica.org\/namibia-le-roux-v-minister-of-home-affairs-and-others\/\" target=\"_blank\" rel=\"noopener noreferrer\">courts have confirmed this <\/a>in several cases.<\/p>\n<p>The 2010 amendments to the citizenship act reflected a trend to restrict access to citizenship, increasing the period of residence required for acquisition of citizenship through marriage or by naturalisation.<\/p>\n<p>The interpretation of &#8220;ordinarily resident&#8221; has been questioned, and in 2016, the <a href=\"http:\/\/citizenshiprightsafrica.org\/namibia-de-wilde-v-minister-of-home-affairs\/\" target=\"_blank\" rel=\"noopener noreferrer\">Supreme Court ruled <\/a>that the interpretation could include a person in Namibia on a temporary residence permit. The government immediately <a href=\"http:\/\/citizenshiprightsafrica.org\/namibia-to-clarify-issue-of-namibian-citizenship\/\" target=\"_blank\" rel=\"noopener noreferrer\">moved to amend the law<\/a> to restrict acquisition of citizenship at birth to chidren whose parents had permanent residence in Namibia, but later <a href=\"http:\/\/citizenshiprightsafrica.org\/namibia-govt-backs-down-on-citizenship\/\" target=\"_blank\" rel=\"noopener noreferrer\">backed down<\/a> from this proposal.<\/p>\n<p>The Namibian constitutional provisions include a protection against statelessness for children born in the territory, although it is not complete (requiring the parents to be ordinarily resident). The law does not provide for a presumption of citizenship in favour of children of unknown parents; an omission which was regretted by the <a href=\"http:\/\/citizenshiprightsafrica.org\/crc-concluding-observations-namibia-2012\/\" target=\"_blank\" rel=\"noopener noreferrer\">UN Committee on the Rights of the Child<\/a> in 2012.
