{"id":22281,"date":"2019-04-04T22:37:01","date_gmt":"2019-04-04T22:37:01","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=22281"},"modified":"2019-04-10T22:40:12","modified_gmt":"2019-04-10T22:40:12","slug":"kenya-reflections-on-the-niims-judgement","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/kenya-reflections-on-the-niims-judgement\/","title":{"rendered":"Kenya: Reflections on the NIIMS Judgement"},"content":{"rendered":"<p id=\"8bd8\" class=\"graf graf--p graf-after--figure\"><em class=\"markup--em markup--p-em\">By Magdi Amin, Investment Partner, Omidyar Network<\/em><\/p>\n<p id=\"8f3e\" class=\"graf graf--p graf--hasDropCapModel graf--hasDropCap graf-after--p\"><span class=\"graf-dropCap\">T<\/span>his week, the High Court of Kenya suspended core aspects of the National Integrated Identity Management System (NIIMS), popularly referred to as Huduma Namba, meaning \u201cgovernment service number,\u201d pending hearings and the resolution of legal suits filed against the program.<\/p>\n<p id=\"238f\" class=\"graf graf--p graf-after--p\">The court\u2019s decision gives the Kenyan government, civil society, digital rights advocates, citizens, and residents an opportunity to make changes that ensure NIIMS reflects <a class=\"markup--anchor markup--p-anchor\" href=\"http:\/\/www.good-id.org\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-href=\"http:\/\/www.good-id.org\">Good ID<\/a> in design and implementation going forward.<\/p>\n<p id=\"45c6\" class=\"graf graf--p graf-after--p\"><strong class=\"markup--strong markup--p-strong\"><em class=\"markup--em markup--p-em\">Good ID is our normative framing for digital identity systems that focus on individual empowerment while ensuring adequate safeguards.<\/em><\/strong><\/p>\n<p id=\"154a\" class=\"graf graf--p graf-after--p\"><strong class=\"markup--strong markup--p-strong\"><em class=\"markup--em markup--p-em\">At its core, Good ID is inclusive, offers significant personal value, and empowers individuals with privacy, security, and control.<\/em><\/strong><\/p>\n<p id=\"b7da\" class=\"graf graf--p graf-after--p\"><strong class=\"markup--strong markup--p-strong\"><em class=\"markup--em markup--p-em\">Good ID issuers build trust with transparency and accountability.<\/em><\/strong><\/p>\n<p id=\"bf31\" class=\"graf graf--p graf-after--p\"><strong class=\"markup--strong markup--p-strong\"><em class=\"markup--em markup--p-em\">And through thoughtful features, Good ID seeks to address exclusion, discrimination, surveillance, consent, and other key issues of our time.<\/em><\/strong><\/p>\n<p class=\"graf graf--p graf-after--p\">The ruling was in <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/namati.org\/news\/case-filed-stop-new-digital-id-system-kenya\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-href=\"https:\/\/namati.org\/news\/case-filed-stop-new-digital-id-system-kenya\/\">response to a consolidated petition of three separate cases<\/a> filed by the <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/www.khrc.or.ke\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-href=\"https:\/\/www.khrc.or.ke\">Kenya Human Rights Commission<\/a> (KHRC), <a class=\"markup--anchor markup--p-anchor\" href=\"http:\/\/nubianrightsforum.org\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-href=\"http:\/\/nubianrightsforum.org\">Nubian Rights Forum<\/a>, and the <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/www.knchr.org\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-href=\"https:\/\/www.knchr.org\/\">Kenya National Commission on Human Rights<\/a> (KNHCR). They expressed concern that the original design could potentially exclude segments of population. They noted the risks of collecting personally identifiable data at a national level scale without a data protection and privacy framework, safeguards, and recourse for harms.
