Original unamended version. Introducing the requirement for citizenship at birth that one parent be of &#8220;African race&#8221;; and providing for gender equality in transmission of citizenship to children born outside the territory.<\/p>\n<p>PART II-CITIZENSHIP BY BIRTH AND DESCENT<br \/>\n3. Every person who on the 5th day of July, 1966, was under any existing law a citizen of Malawi, shall continue to be a citizen of Malawi after that date.<\/p>\n<p>4.-(1) Every person born in Malawi after the 5th day of July, 1966, shall become a citizen of Malawi on the date of his birth if one of his parents is a citizen of Malawi and is a person of African race:<br \/>\nProvided that the provisions of this subsection shall not apply to a person whose father is a citizen of a country with which Malawi is at war and the birth occurs at a place then under occupation by the enemy.<br \/>\n(2) Where a person born in Malawi after the 5th day of July, 1966, does not become a citizen of Malawi on the date of his birth by virtue of the provisions of subsection (1), such person may be registered as a citizen of Malawi as if he were a person to whom the provisions of section 15 (which relates to registration as citizens of persons who have a close connexion with Malawi) apply:<br \/>\nProvided that the provisions of this subsection shall not apply to a person to whom the proviso to subsection (1) applies.<\/p>\n<p>5.
