{"id":26510,"date":"1965-02-18T12:32:02","date_gmt":"1965-02-18T12:32:02","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=26510"},"modified":"2020-02-27T12:48:02","modified_gmt":"2020-02-27T12:48:02","slug":"gambia-constitution-1965","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/gambia-constitution-1965\/","title":{"rendered":"Gambia Constitution 1965"},"content":{"rendered":"<p>Schedule to The Gambia Independence Order 1965, UK Statutory Instrument No. 135 of 1965<\/p>\n<p>CHAPTER I: CITIZENSHIP<\/p>\n<p>Persons who become citizens on 18th February 1965<br \/>\n1.\u2014(1) Every person who, having been born in The Gambia, is on 17th February 1965 a citizen of the United Kingdom and Colonies or a British protected person shall become a citizen of The Gambia on 18th February 1965:<br \/>\nProvided that a person shall not become a citizen of The Gambia by virtue of this subsection if neither of his parents nor any of his grandparents was born in The Gambia.<br \/>\n(2) Every person who, on 17th February 1965, is a citizen of the United Kingdom and Colonies\u2014<br \/>\n(a) having become such a citizen under the British Nationality Act 1948 by virtue of his having been naturalised in The Gambia as a British subject before that Act came into force; or<br \/>\n(b) having become such a citizen by virtue of his having been naturalised or registered in The Gambia under that Act,<br \/>\nshall become a citizen of The Gambia on 18th February 1965.<br \/>\n(3) Every person who, having been born outside The Gambia, is on 17th February 1965 a citizen of the United Kingdom and Colonies or a British protected person shall, if his father becomes,or would but for his death have become, a citizen of The Gambia by virtue of subsection (1) or subsection (2) of this section, become a citizen of The Gambia on 18th February 1965.<\/p>\n<p>[&#8230;]<\/p>\n<p>Persons born in The Gambia after 17th February 1965<br \/>\n3. Every person born in The Gambia after 17th February 1965 shall become a citizen of The Gambia at the date of his birth:<br \/>\nProvided that a person shall not become a citizen of The Gambia by virtue of this section if at the time of his birth\u2014<br \/>\n(a) neither of his parents is a citizen of The Gambia and his father possesses such immunity from suit and legal process as is accorded to the envoy of a foreign sovereign power accredited to The Gambia; or<br \/>\n(b) his father is a citizen of a country with which The Gambia is at war and the birth occurs in a place then under occupation by that country.<\/p>\n<p>Persons born outside The Gambia after 17th February 1965<br \/>\n4. A person born outside The Gambia after 17th February 1965 shall become a citizen of The Gambia at the date of his birth if, at that date, his father is a citizen of The Gambia otherwise than by virtue of this section or section 1(3) of this Constitution.<\/p>\n<p>Marriage to citizen of The Gambia<br \/>\n5.
