{"id":32487,"date":"2021-07-06T10:44:42","date_gmt":"2021-07-06T10:44:42","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=32487"},"modified":"2021-07-26T10:48:25","modified_gmt":"2021-07-26T10:48:25","slug":"background-note-on-sex-discrimination-in-birth-registration","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/background-note-on-sex-discrimination-in-birth-registration\/","title":{"rendered":"Background Note on Sex Discrimination in Birth Registration"},"content":{"rendered":"<p><strong>Introduction<\/strong><\/p>\n<p><span id=\"page3R_mcid37\" class=\"markedContent\"><span dir=\"ltr\">Birth registration is a fundamental right and an enabler of other <\/span><\/span><span id=\"page3R_mcid38\" class=\"markedContent\"><span dir=\"ltr\">rights as it bestows a legal identity<\/span><\/span><span id=\"page3R_mcid39\" class=\"markedContent\"><\/span><span id=\"page3R_mcid40\" class=\"markedContent\"><span dir=\"ltr\"> on children for life. If a child is <\/span><\/span><span id=\"page3R_mcid41\" class=\"markedContent\"><span dir=\"ltr\">not registered, they do not officially exist and are vulnerable to <\/span><\/span><span id=\"page3R_mcid42\" class=\"markedContent\"><span dir=\"ltr\">violence, abuse, neglect and exploitation. <\/span><\/span><\/p>\n<p><span id=\"page3R_mcid43\" class=\"markedContent\"><\/span><span id=\"page3R_mcid44\" class=\"markedContent\"><span dir=\"ltr\">Without birth registration, a child may not be able to go to school, receive medical <\/span><\/span><span id=\"page3R_mcid45\" class=\"markedContent\"><span dir=\"ltr\">treatment or benefit from social services. The absence of registration can also lead to <\/span><\/span><span id=\"page3R_mcid46\" class=\"markedContent\"><span dir=\"ltr\">statelessness.<\/span><\/span><span id=\"page3R_mcid47\" class=\"markedContent\"><\/span><span id=\"page3R_mcid48\" class=\"markedContent\"><span dir=\"ltr\"> Yet, despite its importance, the births of millions of children around the <\/span><\/span><span id=\"page3R_mcid49\" class=\"markedContent\"><span dir=\"ltr\">world are not registered.<\/span><\/span><span id=\"page3R_mcid50\" class=\"markedContent\"><\/span><span id=\"page3R_mcid51\" class=\"markedContent\"><span dir=\"ltr\"> A multitude of factors can impede birth registration, <\/span><\/span><span id=\"page3R_mcid52\" class=\"markedContent\"><span dir=\"ltr\">including parents\u2019 lack of knowledge of its importance, financial considerations and <\/span><\/span><span id=\"page3R_mcid53\" class=\"markedContent\"><span dir=\"ltr\">practical barriers to accessing birth registration facilities. <\/span><\/span><span id=\"page3R_mcid54\" class=\"markedContent\"><\/span><span id=\"page3R_mcid55\" class=\"markedContent\"><span dir=\"ltr\"> Beyond these factors, <\/span><\/span><span id=\"page3R_mcid56\" class=\"markedContent\"><span dir=\"ltr\">discrimination impeding women\u2019s ability to register the birth of children is also a critical <\/span><\/span><span id=\"page3R_mcid57\" class=\"markedContent\"><span dir=\"ltr\">barrier. Such sex discrimination may be codified in national legislation and regulations, <\/span><\/span><span id=\"page3R_mcid58\" class=\"markedContent\"><span dir=\"ltr\">or may relate to practices based on cultural norms. <\/span><\/span><\/p>\n<p><span id=\"page5R_mcid59\" class=\"markedContent\"><span dir=\"ltr\">Under the umbrella of <\/span><\/span><span id=\"page5R_mcid60\" class=\"markedContent\"><span dir=\"ltr\">The Coalition on Every <\/span><\/span><span id=\"page5R_mcid61\" class=\"markedContent\"><span dir=\"ltr\">Child\u2019s Right to a Nationality<\/span><\/span><span id=\"page5R_mcid62\" class=\"markedContent\"><span dir=\"ltr\">, UNICEF and UNHCR <\/span><\/span><span id=\"page5R_mcid63\" class=\"markedContent\"><span dir=\"ltr\">have produced this background note to explore <\/span><\/span><span id=\"page5R_mcid64\" class=\"markedContent\"><span dir=\"ltr\">the issue of sex discrimination in birth <\/span><\/span><span id=\"page5R_mcid65\" class=\"markedContent\"><span dir=\"ltr\">registration. <\/span><\/span><span id=\"page5R_mcid66\" class=\"markedContent\"><\/span><span id=\"page5R_mcid67\" class=\"markedContent\"><span dir=\"ltr\"> By providing an overview and <\/span><\/span><span id=\"page5R_mcid68\" class=\"markedContent\"><span dir=\"ltr\">country specific examples<\/span><\/span><span id=\"page5R_mcid70\" class=\"markedContent\"><span dir=\"ltr\"> of the kinds of <\/span><\/span><span id=\"page5R_mcid71\" class=\"markedContent\"><span dir=\"ltr\">legislative provisions<\/span><\/span><span id=\"page5R_mcid72\" class=\"markedContent\"><\/span><span id=\"page5R_mcid73\" class=\"markedContent\"><span dir=\"ltr\"> and cultural norms that can <\/span><\/span><span id=\"page5R_mcid74\" class=\"markedContent\"><span dir=\"ltr\">negatively affect women\u2019s ability to register the <\/span><\/span><span id=\"page5R_mcid75\" class=\"markedContent\"><span dir=\"ltr\">birth of their children, it is hoped that it will <\/span><\/span><span id=\"page5R_mcid76\" class=\"markedContent\"><span dir=\"ltr\">support advocacy efforts, and action by States, <\/span><\/span><span id=\"page5R_mcid77\" class=\"markedContent\"><span dir=\"ltr\">that advance a number of the Coalition\u2019s <\/span><\/span><span id=\"page5R_mcid78\" class=\"markedContent\"><span dir=\"ltr\">objectives, including: <\/span><\/span><\/p>\n<ul>\n<li><span id=\"page5R_mcid80\" class=\"markedContent\"><span dir=\"ltr\">Ensuring that no child is born stateless;<\/span><\/span><\/li>\n<li><span id=\"page5R_mcid82\" class=\"markedContent\"><span dir=\"ltr\">Eliminating laws and practices that deny <\/span><\/span><span id=\"page5R_mcid83\" class=\"markedContent\"><span dir=\"ltr\">children nationality on discriminatory <\/span><\/span><span id=\"page5R_mcid84\" class=\"markedContent\"><span dir=\"ltr\">grounds; and<\/span><\/span><\/li>\n<li><span id=\"page5R_mcid86\" class=\"markedContent\"><span dir=\"ltr\">Improving birth registration to prevent <\/span><\/span><span id=\"page5R_mcid87\" class=\"markedContent\"><span dir=\"ltr\">statelessness.<\/span><\/span><\/li>\n<\/ul>\n<p>Download at: <a href=\"https:\/\/www.refworld.org\/docid\/60e2d0554.html\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.refworld.org\/docid\/60e2d0554.html<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"Introduction Birth registration is a fundamental right and an enabler of other rights as it bestows a legal identity on children for life.
