{"id":35060,"date":"2022-02-28T09:02:48","date_gmt":"2022-02-28T09:02:48","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=35060"},"modified":"2022-03-01T09:06:58","modified_gmt":"2022-03-01T09:06:58","slug":"ugandas-national-id-legislation-its-compliance-with-international-human-rights-obligations","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/ugandas-national-id-legislation-its-compliance-with-international-human-rights-obligations\/","title":{"rendered":"Uganda&#8217;s National ID Legislation &#038; its compliance with International Human Rights obligations"},"content":{"rendered":"<p><span id=\"page5R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The aim of this legal opinion is to analyze a recent legal measure adopted by the<\/span><\/span><span id=\"page5R_mcid14\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">government of Uganda whose main purpose was to\u00a0 harmonize and consolidate<\/span><\/span><span id=\"page5R_mcid15\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">the law on registrations of persons and to provide for a registration of individuals, in<\/span><\/span><span id=\"page5R_mcid16\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">terms of its compliance with the international human rights obligations acquired<\/span><\/span><span id=\"page5R_mcid17\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">by Uganda. This paper will revise the legal dispositions of both the Registrations<\/span><\/span><span id=\"page5R_mcid18\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of Persons Act and the Statutory Instruments &#8211; by means of which the Act is<\/span><\/span><span id=\"page5R_mcid19\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">implemented \u2013 and determine if they fulfill the international standards set forth<\/span><\/span><span id=\"page5R_mcid20\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">in the International Covenant for Economic, Social and Cultural Rights and other<\/span><\/span><span id=\"page5R_mcid21\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">international treaties. In addition, this legal research will present a formal proposal<\/span><\/span><span id=\"page5R_mcid22\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">to the government of Uganda, specifically to the Parliament and the National<\/span><\/span><span id=\"page5R_mcid23\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Identification &amp; Registration Authority, which looks to amend a set of sections<\/span><\/span><span id=\"page5R_mcid24\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of the aforementioned legislation, in order to assure that the national digital ID<\/span><\/span><span id=\"page5R_mcid25\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">system (<\/span><\/span><span id=\"page5R_mcid26\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Ndaga Muntu<\/span><\/span><span id=\"page5R_mcid27\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">) becomes a free and inclusive mechanisms for all Ugandan<\/span><\/span><span id=\"page5R_mcid28\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">population.<\/span><\/span><span id=\"page5R_mcid29\" class=\"markedContent\"><\/span><\/p>\n<p><span id=\"page5R_mcid29\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In order to do so, this paper will implement the following structure: (i) the first<\/span><\/span><span id=\"page5R_mcid30\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">chapter will start by giving a general contextualization of the national digital ID<\/span><\/span><span id=\"page5R_mcid31\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">system in Uganda and will also include a brief summary of the previous research<\/span><\/span><span id=\"page5R_mcid32\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">studies that have been carried out on this subject; (ii) the second chapter will<\/span><\/span><span id=\"page5R_mcid33\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">continue by giving a general overview of the main criticisms originated in the<\/span><\/span><span id=\"page5R_mcid34\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">law governing the<\/span><\/span><span id=\"page5R_mcid35\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Ndaga Muntu<\/span><\/span><span id=\"page5R_mcid36\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">; (iii) the third chapter will provide a legal analysis<\/span><\/span><span id=\"page5R_mcid37\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">on the legislation regulating the<\/span><\/span><span id=\"page5R_mcid38\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Ndaga Muntu<\/span><\/span><span id=\"page5R_mcid39\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and its compliance with the<\/span><\/span><span id=\"page5R_mcid40\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">international human rights obligations on economic, social and cultural rights<\/span><\/span><span id=\"page5R_mcid41\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and the right to privacy and data protection and (v) the fourth and final chapter<\/span><\/span><span id=\"page5R_mcid42\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">will present a proposal to amend the legislation to guarantee that all people living<\/span><\/span><span id=\"page5R_mcid43\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">in Uganda can access, in an inclusive, safety and easy way, the national digital ID <\/span><\/span><span id=\"page5R_mcid44\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">system.<\/span><\/span><\/p>\n<p>Download: <a href=\"https:\/\/www.unwantedwitness.org\/download\/Legal-Analysis-of-Ugandas-National-ID-Legislation.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/www.unwantedwitness.org\/download\/Legal-Analysis-of-Ugandas-National-ID-Legislation.pdf<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"The aim of this legal opinion is to analyze a recent legal measure adopted by the government of Uganda whose main purpose was to\u00a0 harmonize and consolidate the law on registrations of persons and to provide for a registration of individuals, in terms of its compliance with the international human rights obligations acquired by Uganda.
