{"id":35676,"date":"1996-12-16T19:56:40","date_gmt":"1996-12-16T19:56:40","guid":{"rendered":"https:\/\/citizenshiprightsafrica.org\/?p=35676"},"modified":"2022-04-18T20:11:18","modified_gmt":"2022-04-18T20:11:18","slug":"ghana-constitution-amendment-act-1996","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/ghana-constitution-amendment-act-1996\/","title":{"rendered":"Ghana Constitution Amendment Act 1996"},"content":{"rendered":"<p><span id=\"page15432R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page15432R_mcid14\" class=\"markedContent\"><span id=\"page15432R_mcid9\" class=\"markedContent\">THE CONSTITUTION OF THE REPUBLIC OF GHANA (AMENDMENT) ACT, 1996<br \/>\n<\/span><\/span><\/span><\/span><\/p>\n<p>Act 527.<\/p>\n<p><span id=\"page15432R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page15432R_mcid14\" class=\"markedContent\">Article 8 of the Constitution substituted.<\/span><\/span><\/span><\/p>\n<p><span id=\"page15432R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page15432R_mcid14\" class=\"markedContent\">&#8220;Dual citizenship<\/span><\/span><\/span><\/p>\n<p><span id=\"page15432R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">I.<\/span><\/span><span id=\"page15432R_mcid16\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Article 8<\/span> <span dir=\"ltr\" role=\"presentation\">of the Constitution is repealed and the following inserted<\/span><\/span><span id=\"page15432R_mcid17\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page15432R_mcid18\" class=\"markedContent\"><\/span><\/p>\n<p><span id=\"page15432R_mcid18\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">8<\/span> <span dir=\"ltr\" role=\"presentation\">(1)<\/span> <span dir=\"ltr\" role=\"presentation\">A citizen of Ghana may hold the citizenship of any other country<\/span> <span dir=\"ltr\" role=\"presentation\">in addition<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">his citizenship of Ghana<\/span><\/span><span id=\"page15432R_mcid19\" class=\"markedContent\">.<\/span><\/p>\n<p><span id=\"page15432R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(2)<\/span> <span dir=\"ltr\" role=\"presentation\">Without prejudice<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">article<\/span> <span dir=\"ltr\" role=\"presentation\">94 (2)<\/span>(<span dir=\"ltr\" role=\"presentation\">a)<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">Constitution,<\/span> <span dir=\"ltr\" role=\"presentation\">no<\/span> <span dir=\"ltr\" role=\"presentation\">citizen or Ghana shall qualify to be appointed as a holder of any<\/span> <span dir=\"ltr\" role=\"presentation\">office<\/span> <\/span><span id=\"page15432R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">specified in this clause if he holds<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">citizenship of&#8221; any other country <\/span><span dir=\"ltr\" role=\"presentation\">in addition<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">his citizenship of Ghana<\/span><\/span><span id=\"page15432R_mcid21\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page15432R_mcid22\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(0)<\/span><\/span><span id=\"page15432R_mcid23\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Ambassador or High Commissioner:<\/span><\/span><span id=\"page15432R_mcid24\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(h)<\/span><\/span><span id=\"page15432R_mcid25\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Secretary<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">the Cabinet;<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(e)<\/span> <span dir=\"ltr\" role=\"presentation\">Chief<\/span> <span dir=\"ltr\" role=\"presentation\">of Defence Staff or any<\/span> <span dir=\"ltr\" role=\"presentation\">Service Chief:<\/span><\/span><span id=\"page15432R_mcid26\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(d)<\/span><\/span><span id=\"page15432R_mcid27\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Inspector-General of Police;<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(e)<\/span> <span dir=\"ltr\" role=\"presentation\">Commissioner. Customs, Excise and Preventive Service:<br \/>\n<span id=\"page1R_mcid1\" class=\"markedContent\">(j)<\/span><span id=\"page1R_mcid2\" class=\"markedContent\"> Director of Immigration Service; and<\/span><span id=\"page1R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/>(g)<\/span><span id=\"page1R_mcid4\" class=\"markedContent\"> any office specified by an Act of Parliament.<\/span><span id=\"page1R_mcid5\" class=\"markedContent\"><\/span><\/span><\/span><\/p>\n<p><span id=\"page15432R_mcid27\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page1R_mcid5\" class=\"markedContent\">3.<\/span><span id=\"page1R_mcid6\" class=\"markedContent\"> Where the law of a country requires a person who marries a citizen of that country to renounce the citizenship of his own Country by virtue of that marriage, a citizen of Ghana who is deprived of his citizenship of Ghana by virtue of that marriage shall, on the dissolution of that marriage, become a citizen of Ghana.&#8221;<\/span><span id=\"page1R_mcid7\" class=\"markedContent\"><\/span><\/span><\/span><\/p>\n<p><span id=\"page15432R_mcid27\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page1R_mcid7\" class=\"markedContent\">Article 9 of the Constitution amended.<\/span><\/span><\/span><\/p>\n<p><span id=\"page15432R_mcid27\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page1R_mcid8\" class=\"markedContent\">2.<\/span><span id=\"page1R_mcid9\" class=\"markedContent\"> Article 9 of the Constitution is amended by the repeal of clause (5)<\/span><span id=\"page1R_mcid10\" class=\"markedContent\"> thereof and the insertion of the following:<br \/>\n&#8220;(5) Parliament may make provision by Act of Parliament for<\/span><span id=\"page1R_mcid11\" class=\"markedContent\"> (a)<\/span><span id=\"page1R_mcid12\" class=\"markedContent\"> the renunciation by any person of his citizenship of Ghana;<\/span><span id=\"page1R_mcid13\" class=\"markedContent\"><br role=\"presentation\" \/>(b)<\/span><span id=\"page1R_mcid14\" class=\"markedContent\"> the circumstances in which a person may acquire citizenship of Ghana or cease to be a citizen of Ghana<\/span>.&#8221;<\/span><\/span><\/p>\n<p>Download: <a href=\"http:\/\/citizenshiprightsafrica.org\/wp-content\/uploads\/1996\/12\/Ghana-Constitution-Amendment-Act-1996.pdf\">Ghana Constitution Amendment Act 1996<\/a><\/p>\n<p>&#8220;Clean&#8221; PDF: <a href=\"http:\/\/citizenshiprightsafrica.org\/wp-content\/uploads\/2016\/07\/Ghana-Constitution-of-Ghana-Amendment-Act-1996.pdf\">Constitution of Ghana Amendment Act 1996<\/a><\/p>\n<p>Download full text of the constitution with 1996 amendments integrated : <a href=\"https:\/\/www.constituteproject.org\/constitution\/Ghana_1996.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/www.constituteproject.org\/constitution\/Ghana_1996.pdf<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"THE CONSTITUTION OF THE REPUBLIC OF GHANA (AMENDMENT) ACT, 1996 Act 527.
