THE CONSTITUTION OF THE REPUBLIC OF GHANA (AMENDMENT) ACT, 1996
\n<\/span><\/span><\/span><\/span><\/p>\n

Act 527.<\/p>\n

Article 8 of the Constitution substituted.<\/span><\/span><\/span><\/p>\n

“Dual citizenship<\/span><\/span><\/span><\/p>\n

I.<\/span><\/span> Article 8<\/span> of the Constitution is repealed and the following inserted<\/span><\/span> –<\/span><\/span><\/span><\/p>\n

8<\/span> (1)<\/span> A citizen of Ghana may hold the citizenship of any other country<\/span> in addition<\/span> to<\/span> his citizenship of Ghana<\/span><\/span>.<\/span><\/p>\n

(2)<\/span> Without prejudice<\/span> to<\/span> article<\/span> 94 (2)<\/span>(a)<\/span> of<\/span> the<\/span> Constitution,<\/span> no<\/span> citizen or Ghana shall qualify to be appointed as a holder of any<\/span> office<\/span> <\/span>specified in this clause if he holds<\/span> the<\/span> citizenship of” any other country <\/span>in addition<\/span> to<\/span> his citizenship of Ghana<\/span><\/span> –<\/span><\/span>
(0)<\/span><\/span> Ambassador or High Commissioner:<\/span><\/span>
(h)<\/span><\/span> Secretary<\/span> to<\/span> the Cabinet;<\/span>
(e)<\/span> Chief<\/span> of Defence Staff or any<\/span> Service Chief:<\/span><\/span>
(d)<\/span><\/span> Inspector-General of Police;<\/span>
(e)<\/span> Commissioner. Customs, Excise and Preventive Service:
\n(j)<\/span> Director of Immigration Service; and<\/span>
(g)<\/span> any office specified by an Act of Parliament.<\/span><\/span><\/span><\/span><\/p>\n

3.<\/span> Where the law of a country requires a person who marries a citizen of that country to renounce the citizenship of his own Country by virtue of that marriage, a citizen of Ghana who is deprived of his citizenship of Ghana by virtue of that marriage shall, on the dissolution of that marriage, become a citizen of Ghana.”<\/span><\/span><\/span><\/span><\/p>\n

Article 9 of the Constitution amended.<\/span><\/span><\/span><\/p>\n

2.<\/span> Article 9 of the Constitution is amended by the repeal of clause (5)<\/span> thereof and the insertion of the following:
\n“(5) Parliament may make provision by Act of Parliament for<\/span> (a)<\/span> the renunciation by any person of his citizenship of Ghana;<\/span>
(b)<\/span> the circumstances in which a person may acquire citizenship of Ghana or cease to be a citizen of Ghana<\/span>.”<\/span><\/span><\/p>\n
