{"id":36745,"date":"2022-10-28T09:43:25","date_gmt":"2022-10-28T09:43:25","guid":{"rendered":"https:\/\/citizenshiprightsafrica.org\/?p=36745"},"modified":"2022-10-28T09:43:25","modified_gmt":"2022-10-28T09:43:25","slug":"decree-on-libyan-womens-non-citizen-children-fails-discrimination-test","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/decree-on-libyan-womens-non-citizen-children-fails-discrimination-test\/","title":{"rendered":"Decree on Libyan Women\u2019s Non-Citizen Children Fails Discrimination Test"},"content":{"rendered":"<div class=\"container-large max-w-lg mx-auto px-6 sm:px-8 md:pr-14 md:pl-24 x2l:px-0 x2l:mx-32 x3l:mx-auto\">\n<header class=\"news-header max-w-lg mt-6 md:mt-0 mb-4 sm:mb-6 md:mb-12\">\n<div class=\"news-header__main text-gray-800\">\n<p class=\"news-header__subtitle text-base md:text-2xl \"><em>Non-citizen Children of Libyan Women Still Blocked From Citizenship<\/em><\/p>\n<p>By Hanan M Salah<\/p>\n<\/div>\n<\/header>\n<\/div>\n<div class=\"container-large max-w-lg mx-auto px-6 sm:px-8 md:pr-14 md:pl-24 x2l:px-0 x2l:mx-32 x3l:mx-auto\">\n<div class=\"grid-2-1-content x2l:flex lg:flex mx-auto justify-between \">\n<div class=\"grid-2 w-full flex-col lg:flex lg:w-3\/5 lg:px-0 \">\n<div>\n<div class=\"mb-8 md:mb-14\">\n<div>\n<div class=\"article-body article-body--contained rich-text mx-auto\">\n<p>On October 19, the Council of Ministers of the\u00a0<a href=\"https:\/\/www.hrw.org\/middle-east\/n-africa\/libya\">Libyan<\/a>\u00a0Government of National Unity (GNU)\u00a0<a href=\"https:\/\/www.hrw.org\/sites\/default\/files\/media_2022\/10\/202210mena_libya_GNU_decree.pdf\">issued a new Decree stating<\/a>\u00a0that non-citizen children of Libyan women would be granted \u201call rights entitled to Libyan citizens.\u201d The decree mentions access to free education, free medical treatment, and visa-free entry to Libya, but falls short of guaranteeing the right of children of Libyan women to obtain nationality like children of Libyan men on an equal basis.<\/p>\n<p>Without Libyan nationality, non-citizen children of Libyan women face difficulties including in obtaining identity documents. Their civil and political rights are severely limited, preventing them from voting in elections and shutting them out of public sector jobs.<\/p>\n<p>Obtaining Libyan citizenship is governed by\u00a0<a href=\"https:\/\/www.refworld.org\/pdfid\/4e2d8bf52.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Nationality Law 24\/2010<\/a>\u00a0which defines a Libyan as one who is born to a Libyan father or born in Libya to a Libyan mother and a non-Libyan father who is either stateless or whose nationality is unknown. Otherwise, the law provides that children of Libyan women married to non-Libyans may be granted citizenship, but this is not automatic. Such children can only\u00a0<a href=\"https:\/\/www.facebook.com\/photo\/?fbid=952901824918086&amp;set=pcb.952902528251349\" target=\"_blank\" rel=\"noopener noreferrer\">request nationality<\/a>\u00a0after they reach the age of majority unless their father has died or is legally deemed missing, and their parents and an official body approve the request. Children of Libyan women married to Palestinians cannot obtain nationality.<\/p>\n<p>Libyan women not only face discrimination relating to their children but also face hurdles in obtaining marriage licenses to marry non-Libyans after Libya\u2019s Grand Mufti called on authorities to ban women from marrying foreigners in 2013. Libyan men have no restrictions on marrying non-Libyans, can automatically confer citizenship to their children, and their non-Libyan spouses can easily obtain it.<\/p>\n<p>Libyan women face other\u00a0<a href=\"https:\/\/www.hrw.org\/world-report\/2022\/country-chapters\/libya\">discrimination<\/a>\u00a0on issues pertaining to marriage, inheritance, and divorce, and have no effective legal protection against domestic and sexual violence.<\/p>\n<p>Discrimination on the basis of gender contravenes Libya\u2019s 2011\u00a0<a href=\"https:\/\/www.constituteproject.org\/constitution\/Libya_2011.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Constitutional Covenant<\/a>\u00a0which guarantees that \u201cLibyans shall be equal before the law [\u2026] without distinction on the grounds of religion, belief, language, wealth, gender, kinship [\u2026].\u201d It also breaches Libya\u2019s international law obligations not to discriminate against women and their children.<\/p>\n<p>Until the country\u2019s legislative authority, the dysfunctional eastern-based House of Representatives, amends Libya\u2019s Nationality Law, the new decree should be considered an interim measure.
