{"id":42084,"date":"2024-12-30T17:40:27","date_gmt":"2024-12-30T17:40:27","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=42084"},"modified":"2025-01-25T17:42:20","modified_gmt":"2025-01-25T17:42:20","slug":"namibia-marriage-act-no-14-of-2024","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/en\/namibia-marriage-act-no-14-of-2024\/","title":{"rendered":"Namibia: Marriage Act, No. 14 of 2024"},"content":{"rendered":"<p><span dir=\"ltr\" role=\"presentation\">To<\/span> <span dir=\"ltr\" role=\"presentation\">regulate the solemnisation of marriages; to provide for the validation and <\/span><span dir=\"ltr\" role=\"presentation\">recognition of certain marriages; and to provide for incidental matters.<\/span><\/p>\n<p>Section 32 provides:<\/p>\n<p><span dir=\"ltr\" role=\"presentation\">Good faith marriages<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(1)<\/span> <span dir=\"ltr\" role=\"presentation\">A marriage between a Namibian citizen and a foreign national <\/span><span dir=\"ltr\" role=\"presentation\">who is not a permanent resident of Namibia is not in good faith and not valid for the<\/span> <span dir=\"ltr\" role=\"presentation\">purposes of domicile, residence or citizenship in Namibia if the Minister concludes, <\/span><span dir=\"ltr\" role=\"presentation\">after an investigation as provided for in this Act,<\/span> <span dir=\"ltr\" role=\"presentation\">that the marriage was entered into<\/span> <span dir=\"ltr\" role=\"presentation\">primarily for the purpose of the foreign national acquiring Namibian domicile, residence <\/span><span dir=\"ltr\" role=\"presentation\">or citizenship, even if the marriage meets all the other requirements of this Act.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(2)<\/span> <span dir=\"ltr\" role=\"presentation\">The Minister must prescribe criteria which may be used to determine <\/span><span dir=\"ltr\" role=\"presentation\">the good faith of a marriage under subsection (1).<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(3)<\/span> <span dir=\"ltr\" role=\"presentation\">The Minister must cause an investigation to be carried out according<\/span> <span dir=\"ltr\" role=\"presentation\">to the prescribed rules and procedures in respect of a marriage that is suspected of not<\/span> <span dir=\"ltr\" role=\"presentation\">being in good faith.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(4)<\/span> <span dir=\"ltr\" role=\"presentation\">The investigation must be concluded within a reasonable period after <\/span><span dir=\"ltr\" role=\"presentation\">the solemnisation of the marriage<\/span><\/p>\n<p>Download: <a href=\"https:\/\/gazettes.africa\/akn\/na\/officialGazette\/government-gazette\/2024-12-30\/8548\/eng@2024-12-30\" target=\"_blank\" rel=\"noopener\">https:\/\/gazettes.africa\/akn\/na\/officialGazette\/government-gazette\/2024-12-30\/8548\/eng@2024-12-30<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"To regulate the solemnisation of marriages; to provide for the validation and recognition of certain marriages; and to provide for incidental matters.
