{"id":14295,"date":"2016-11-21T18:07:04","date_gmt":"2016-11-21T18:07:04","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=14295"},"modified":"2020-09-09T15:50:15","modified_gmt":"2020-09-09T15:50:15","slug":"angolan-ex-refugees-given-chance-to-apply-for-residency-in-south-africa","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/fr\/angolan-ex-refugees-given-chance-to-apply-for-residency-in-south-africa\/","title":{"rendered":"Angolan ex-refugees given chance to apply for residency in South Africa"},"content":{"rendered":"<p>Last week, on <span class=\"numbers\">17<\/span> Novem\u00adber <span class=\"numbers\">2016<\/span>, a set\u00adtle\u00adment was reached in a year-long case regard\u00ading for\u00admer Angolan refugees still liv\u00ading in South Africa on expired Angolan Ces\u00adsa\u00adtion Per\u00admits.<\/p>\n<p>The nego\u00adti\u00adated set\u00adtle\u00adment allows for for\u00admer Angolan refugees falling into this cat\u00ade\u00adgory to sub\u00admit fur\u00adther doc\u00adu\u00adments to the Depart\u00adment of Home Affairs in order to attempt to reg\u00adu\u00adlarise their stay in South Africa and apply for per\u00adma\u00adnent res\u00adi\u00addency.<\/p>\n<p>The Legal Resources Cen\u00adtre (<span class=\"caps\">LRC<\/span>) rep\u00adre\u00adsented Scal\u00adabrini Cen\u00adtre of Cape Town and a num\u00adber of for\u00admer Angolan refugees in lit\u00adi\u00adga\u00adtion against the Depart\u00adment of Home Affairs regard\u00ading the legal sta\u00adtus of for\u00admer Angolan refugees in South Africa.<\/p>\n<p>In <span class=\"numbers\">2013<\/span>, Home Affairs decided that for\u00admer Angolan refugees no longer needed the pro\u00adtec\u00adtion of the South African gov\u00adern\u00adment, as Angola was con\u00adsid\u00adered polit\u00adi\u00adcally sta\u00adble. Those Angolans who had been recog\u00adnised refugees in South Africa were advised to apply for a spe\u00adcial type of visa (Angolan Ces\u00adsa\u00adtion Process Per\u00admit) which would allow them to legally work and study in South Africa for another two years, while mak\u00ading plans to return to their coun\u00adtry.<\/p>\n<p>Many Angolans have lived in South Africa for close to <span class=\"numbers\">20<\/span> years. They have cre\u00adated lives for them\u00adselves and raised their fam\u00adi\u00adlies in South Africa.<\/p>\n<p>How\u00adever, the <span class=\"caps\">ACP<\/span> per\u00admit was non-renewable. This meant that, as these per\u00admits expired, Angolans that were for\u00admerly recog\u00adnised as refugees were ren\u00addered ille\u00adgal in the coun\u00adtry that many of them have called home for close to two decades.<\/p>\n<p>The <span class=\"caps\">LRC<\/span>\u2019s client, Scal\u00adabrini Cen\u00adtre Cape Town, tried to assist such Angolans in nego\u00adti\u00ada\u00adtions with Home Affairs, as well as to apply for per\u00adma\u00adnent res\u00adi\u00addency. Scal\u00adabrini also applied for a group exemp\u00adtion for these per\u00adsons in terms of sec\u00adtion <span class=\"numbers\">31<\/span>(<span class=\"numbers\">2<\/span>)(b) of the Immi\u00adgra\u00adtion Act.<\/p>\n<p>When these appli\u00adca\u00adtions did not suc\u00adceed, Scal\u00adabrini approached the <span class=\"caps\">LRC<\/span> for assis\u00adtance in lit\u00adi\u00adgat\u00ading for the rights of Angolans who had pre\u00advi\u00adously held <span class=\"caps\">ACP<\/span> Per\u00admits.<\/p>\n<p>After exten\u00adsive legal and set\u00adtle\u00adment nego\u00adti\u00ada\u00adtions with the Depart\u00adment, the Cape Town High Court issued an order by agree\u00adment between the par\u00adties. As part of this order, all Angolans who have held <span class=\"caps\">ACP<\/span> Per\u00admits are now able to sub\u00admit appli\u00adca\u00adtions for per\u00adma\u00adnent res\u00adi\u00addence and are exempted from pay\u00ading the usual appli\u00adca\u00adtion fee.<\/p>\n<p>These appli\u00adca\u00adtions must first be sub\u00admit\u00adted to Scal\u00adabrini Cen\u00adtre, accom\u00adpa\u00adnied by cer\u00adtain doc\u00adu\u00adments, and Scal\u00adabrini has under\u00adtaken to col\u00adlate the appli\u00adca\u00adtions and sub\u00admit them to the Depart\u00adment of Home Affairs.
