{"id":27405,"date":"2020-06-29T16:07:09","date_gmt":"2020-06-29T16:07:09","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/?p=27405"},"modified":"2020-06-29T16:07:09","modified_gmt":"2020-06-29T16:07:09","slug":"south-africa-case-note-mulowayi-v-minister-of-home-affairs-2019-zacc-1-29-january-2019","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/fr\/south-africa-case-note-mulowayi-v-minister-of-home-affairs-2019-zacc-1-29-january-2019\/","title":{"rendered":"South Africa: Case Note: Mulowayi v Minister of Home Affairs [2019] ZACC 1 (29 January 2019)"},"content":{"rendered":"<div class=\"row\">\n<div class=\"main_entry\">\n<p>By Jo Venkov<\/p>\n<p>Introduction<\/p>\n<p>Mulowayi v Minister of Home Affairs (\u2018Mulowayi\u2019) is an appeal to the South African Constitutional Court (\u2018Constitutional Court\u2019) from a decision of the High Court of South Africa (\u2018High Court\u2019) dealing with the validity of a regulation amending the South African Citizenship Act<br \/>\n(\u2018SACA\u2019).<\/p>\n<p>Although the Constitutional Court\u2019s decision deals with the error of the High Court, some of the judgment is devoted to a discussion on the status of the third applicant, Mr and Mrs Mulowayi\u2019s son Gaddiel. Gaddiel is stateless and faces legal and practical obstacles to obtaining South African citizenship. It is the Constitutional Court\u2019s obiter comments on the wider issues arising from South Africa&rsquo;s citizenship regime \u2014 especially as they affect stateless people \u2014 that are of most interest. Navigating complex administrative processes to give effect to rights available under citizenship laws is one of the hurdles that many stateless people face.
