This report compiles the opinions of legal\u00a0 experts as to the two questions asked of the experts by UNDP\/Sudan, which were:<\/p>\n

  1. With respect to defining \u201ccriteria for residency\u201d in this context, what guiding or required principles and policies, if any, are set forth in the direct enabling laws, in this case, the CPA (including the\u00a0 Abyei\u00a0 Protocol),\u00a0 the\u00a0 Interim\u00a0 National\u00a0 Constitution\u00a0 under\u00a0 which\u00a0 the\u00a0 AARA\u00a0 was enacted, and the Abyei Area Referendum Act (collectively, the \u201cEnabling Law\u201d)?<\/li>\n
  2. To the\u00a0 extent\u00a0 the\u00a0 Enabling\u00a0 Law\u00a0 lacks\u00a0 express\u00a0 or\u00a0 sufficient\u00a0 guidance\u00a0 or\u00a0 requirements,\u00a0 what\u00a0 principles\u00a0 and\u00a0 policies\u00a0 are\u00a0 expressed\u00a0 in\u00a0 analogous\u00a0 laws\u00a0 and\u00a0 situations\u00a0 in\u00a0 other\u00a0 jurisdictions\u00a0 (i.e.\u00a0 countries)\u00a0 or\u00a0 relevant\u00a0 best\u00a0 practice\u00a0 guidelines,\u00a0 international\u00a0 compacts,\u00a0 or\u00a0 treatises\u00a0 that\u00a0 would\u00a0 provide\u00a0 useful\u00a0 guidance\u00a0 for\u00a0 the\u00a0 ARC\u00a0 to\u00a0 use\u00a0 in\u00a0 its\u00a0 consideration\u00a0 and\u00a0 determination?<\/li>\n<\/ol>\n
