{"id":7724,"date":"2005-09-16T00:00:00","date_gmt":"2005-09-16T00:00:00","guid":{"rendered":"http:\/\/citizenshiprightsafrica.org\/2005-zimbabwe-constitution-amendment-17-act\/?lang=fr"},"modified":"2019-04-29T08:53:20","modified_gmt":"2019-04-29T08:53:20","slug":"2005-zimbabwe-constitution-amendment-17-act","status":"publish","type":"post","link":"https:\/\/citizenshiprightsafrica.org\/fr\/2005-zimbabwe-constitution-amendment-17-act\/","title":{"rendered":"Constitution of  Zimbabwe Amendment (No. 17) Act 2005"},"content":{"rendered":"<p>Amends sections 22 and 23 of the constitution on freedom of movement and non-discrimination.<\/p>\n<p><strong>Amendment of section 22 of Constitution<\/strong><\/p>\n<p>Section 22 (\u201cProtection of freedom of movement\u201d) of the Constitution is amended:<\/p>\n<p>(a) in subsection (3)(a) by the deletion of \u201cin the interests of defence, public safety, public order, public morality or public health\u201d and the substitution of \u201cin the national interest, or in the interests of defence, public safety, public order, public morality, public health, the public interest or the economic interests of the State\u201d;<\/p>\n<p>(b) in subsection (4) by the deletion of \u201cpreventing any person from leaving Zimbabwe or\u201d.<\/p>\n<p><strong>Amendment of section 23 of Constitution<\/strong><\/p>\n<p>Section 23 (\u201cProtection from discrimination on the grounds of race, etc.\u201d) of the Constitution is amended:<\/p>\n<p>(a) in subsection (2) by the deletion of \u201cor gender\u201d wherever it occurs and the substitution of \u00ab\u00a0, sex, gender, marital status or physical disability\u00a0\u00bb;<\/p>\n<p>(b) in subsection (3)\u2014<\/p>\n<p>(i) by the repeal of paragraph (a) and the substitution of\u2014 \u00ab\u00a0(a) matters of personal law;\u00a0\u00bb;<\/p>\n<p>(ii) in paragraph (d) by the deletion of \u201cor gender\u201d and the substitution of \u00ab\u00a0, sex, gender, marital status or physical disability\u00a0\u00bb;<\/p>\n<p>(iii) by the insertion of the following paragraph after paragraph (f)\u2014 \u201cor (g) the implementation of affirmative action programmes for the protection or advancement of persons or classes of persons who have been previously disadvantaged by unfair discrimination.\u201d;<\/p>\n<p>(c) by the insertion of the following subsection after subsection (3)\u2014 \u00ab\u00a0(3a) Notwithstanding subsection (3)(b), in implementing any programme of land reform the Government shall treat men and women on an equal basis with respect to the allocation or distribution of land or any right or interest therein under that programme.\u00a0\u00bb;<\/p>\n<p>Download file:\u00a0<a href=\"http:\/\/citizenshiprightsafrica.org\/wp-content\/uploads\/2016\/02\/Zimbabwe-Constitution-Amd-Act-17-2005.pdf\">Constitution Amendment No 17 Act 2005<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"Amends sections 22 and 23 of the constitution on freedom of movement and non-discrimination.
