Le cadre du code de la nationalité au Ghana a été modifié à plusieurs reprises et est actuellement exposé au chapitre III de la Constitution de 1992 et dans le code dit Citizenship Act de 2000. La Constitution prévoit que toute personne née après son entrée en vigueur, que ce soit sur le territoire ou en dehors du Ghana « aura la nationalité ghanéenne à la date de sa naissance si l’un de ses parents ou grands-parents est ou était citoyen du Ghana. » Elle prévoit également une présomption de nationalité en faveur des enfants de parents inconnus. Depuis 1996, certains amendements à la Constitution autorisent la double nationalité.
En 2015, le Comité des Nations Unies des droits de l’enfant a salué des améliorations substantielles dans le domaine de l’enregistrement des naissances, mais a appelé à redoubler d’efforts pour veiller à ce que tous les enfants soient enregistrés. Le Comité a également recommandé le renforcement des protections contre l’apatridie dans les lois nationales du Ghana.
