Au Libéria, la nationalité est régie par le chapitre 4 de la Constitution de 1986 et le Code de la nationalité de 1973, la Aliens and Nationality Law, tel que modifié en 2022. La Constitution et le code instaurent tous deux la discrimination sur la base de la race, en déclarant que « seules les personnes noirs [Negro] ou d’ascendance noire peuvent prétendre à la nationalité libérienne d’origine ou par naturalisation. »
En 2022, la Aliens and Nationality Law a été modifiée pour éliminer la discrimination fondée sur le sexe dans la transmission de la nationalité aux enfants nés hors du Libéria. La loi modifiée a conservé l’attribution statutaire de la nationalité à tout enfant né au Libéria (s’il est d’« ascendance noire »); la Constitution de 1986, cependant, ne prévoit explicitement l’acquisition de la nationalité d’origine que si le père ou la mère est ressortissant libérien.
Jusqu’en 2022, l’effet combiné de la Constitution et de la Aliens and Nationality Law était d’interdire la double nationalité aux adultes en toutes circonstances. Un référendum organisé en 2020 pour modifier la Constitution afin d’autoriser la double nationalité dans tous les cas (entre autres propositions) n’a pas abouti. Les amendements de 2022 à la loi permettent cependant à un ressortissant libérien qui acquiert une autre nationalité de conserver la nationalité libérienne. Ces modifications faisaient suite à une arrête de la Cour suprême de 2019 qui a statué que la disposition du Code de la nationalité relative à la perte automatique était inconstitutionnelle. L’ambiguïté demeure cependant dans le cas d’une personne ayant un parent libérien et un parent étranger, tenue par la Constitution de renoncer à l’autre nationalité à l’âge adulte et avant l’âge de 23 ans pour conserver la nationalité libérienne.
En 2012, le Comité des Nations Unies des droits de l’enfant était préoccupé par le taux très faible d’enregistrement des naissances, et aussi par la restriction de l’octroi de la nationalité sur la base de l’origine raciale. En 2015, le Comité des Nations Unies sur l’élimination de la discrimination à l’égard des femmes avait également exhorté le Liberia à éliminer la discrimination fondée sur le sexe.
La guerre civile au Libéria a entraîné d’importants exodes de réfugiés vers les pays voisins. Bien que la majorité soit revenue, un nombre important est resté dans son pays d’accueil après que le HCR eut conseillé d’invoquer l’article sur les « circonstances ayant cessé » de la Convention sur les réfugiés. Très peu d’entre eux ont pu se naturaliser dans leur pays d’accueil ; certains n’ont pas été considérés comme des citoyens libériens par les autorités libériennes et n’ont donc pas pu régulariser leur situation là où ils vivent actuellement.
