Namibia: Supreme Court confirms child’s citizenship right

A CHILD born in Namibia to non-Namibian parents who meet the legal test of being ordinarily resident in the country is entitled to Namibian citizenship by birth, the Supreme Court affirmed in a landmark judgement on citizenship rights yesterday.
A non-Namibian living in Namibia on the basis of an employment permit can be considered to be ordinarily resident in the country if he or she meets the requirements for such a status, and when a child of such a person is born in Namibia, the child has the right to be a Namibian citizen by birth, the Supreme Court decided in a case in which a Dutch citizen sued the minister of home affairs in an effort to secure Namibian citizenship for one of his sons.
