A l’indépendance, la plupart des pays d’Afrique pratiquaient la discrimination de genre dans les règles relatives à la transmission de la nationalité aux enfants et aux conjoints. Ces dernières années, cependant, les codes de la nationalité ont de plus en plus fait l’objet de réformes pour réduire ou éliminer la discrimination de genre.
La grande majorité des pays africains octroie désormais aux hommes et aux femmes des droits égaux en matière de transmission de la nationalité à leurs enfants ; et environ la moitié pratique l’égalité des droits pour la transmission de la nationalité au conjoint.
Ces réformes sont en conformité avec la Convention des Nations Unies sur l’élimination de toutes les formes de discrimination à l’égard des femmes (CEDEF), qui interdit la discrimination de genre dans le droit relatif à la nationalité : tous les pays africains sont parties à ce traité, à l’exception du Soudan et de la Somalie.
