1. It is declared that the failure or refusal by the respondents, or either of them, or by officials of the Department of Home Affairs (Department), to receive, process and determine an application to register the birth of a child born in South Africa where one parent is a South African citizen, permanent resident or refugee and the other parent is not a South African citizen and does not possess, or is unable to produce, a valid, unexpired passport, visa or permit, on the ground only of the absence of such a document, is unlawful and unconstitutional.
